Raid vs. Outsourcing Firms Yields P23Million in Pirated Software

Three outsourcing companies providing engineering, architectural and IT–related services in Cebu were raided separately by a team from the Anti-Fraud and Computer Crimes Division of the National Bureau of Investigation (NBI-AFCCD). 

The firms are Astir Engineering Works, Inc., a company that provides civil, electrical and architectural engineering services; Jerome B. Posadas Architects (JBPA), the local affiliate of John Shirley Architects and Lloyd E. Platt & Associates in Utah, U.S.A providing architectural services to US-based clients; and Kingmar Corporation, the local affiliate of Kingmar Corporation in Canada providing design, IT and accounting – related services to North American-based clients 

The NBI-AFCCD received information from Bengzon Negre Untalan Intellectual Property Attorneys (BNU), the counsel and attorney-in-fact of Autodesk Inc. in the Philippines. Autodesk, Inc. holds the Intellectual Property Rights over AutoCAD, a software used in computer-aided designs. The establishments were raided on the basis of search warrants secured by NBI agents from a Manila Regional Trial Court.

The raids resulted in the confiscation of 26 desktop computers, two laptops, two CD installers, all loaded with unlicensed copies of different versions of AutoCAD, 3D Studio Max and Revit software. The retail value of the software seized is estimated at PhP23Million. 

“As part of the National Committee on Intellectual Property Rights (NCIPR) and the Pilipinas Anti Piracy Team (PAPT), the NBI will continue to hunt down businesses that are engaged in software piracy activities in whatever part of the country they may be”, NBI Director Nestor Mantaring declared. 

“The list reflects that all these software that were allegedly used without proper licenses are all very important tools for such companies engaged in engineering, architectural and design business. By using unlicensed software, these companies have not only harmed their business, they have also exposed their clients’ business to a lot of security risks,” Mantaring pointed out.

Mr. Mantaring added that “(i)t is but proper for these companies to secure legal license for these software. Aside from the legal concerns, it is also the obligation of these companies to their clients to make sure that services that they are providing are done in a fair and lawful manner.”
